今年もタックスリターンの申告のシーズンがきました。
例年のように、申告に関するご質問にお答えしたいと思います。

このトピックへのご質問の多くは、アメリカに来て最初の
タックスリターンを申告する日本からのビザ滞在者がかなりの
数に上ります。

そこで、特にJビザの方の申告の概要を説明いたします。

Jビザの場合は、仮にアメリカに一年の内１２か月滞在したとしても
Non Resident Alien（非居住外国人）という扱いになります。
これに対して、Eビザあるいは永住権保持者の場合には
Resident Alien（居住外国人）というステータスになります。

Jビザの場合には、ビザの猶予期間が２年間ということで、
２年を過ぎるまでは、Non Resident Alienで申告は１０４０NRのフォーム
になります。

しかし、2年から３年になった時点（年の中間時点）、その年の申告は
Dual Statusの申告になり、１０４０NRと１０４０の２つのフォームにて
申告をします。

３年以上経過した時点で、Non Resident AlienからResident Alienという
扱いになります。Jビザのステータスが同じでも、申告に関しては
純粋に３年を過ぎた時点で、１０４０にての申告になります。

さらに、この時点で奥様あるいはお子様も申告にジョイントとしての
申告が可能になります。しかし、この場合には、申告書にITIN番号（
ソーシャルセキュリティ番号にかわる番号）の申請書を添付しての
申告となります。

さらに、３年を過ぎて4年あるいは５年目に日本に帰国する年には
再度、Resident AlienからNon Residentになり、その場合には
Dual Statusの申告で１０４０と１０４０NRの両方のフォームでの
申告となります。

さらに、最後の申告に関しては、この年を最後の所得税申告とするという
ステートメントを添付し、今後、外国人に戻るので今後アメリカでの所得税
の申告はしない旨をIRSに通知します。

以上がJビザ所有者の申告になりますが、規則はあくまでも、連邦（Federal）
に関するもので、State(州)申告に関して、Federalと同じものではありません。
州に関しては、Non Resident Alienというステータスは存在しません。
州外者、あるいは州在住者という分け方をしますので、申告に関するルールは
州独自のものになります。

また、参考までに、
帰国をする日本人の場合の申告に関する処理に関して説明を加えます。

永住者が日本へ永住帰国する場合の申告に関して、
Jビザの帰国時と同じで、基本的に今まではResident Alienで１０４０にての
申告でしたが、最後の年には、Non Resident Alienとしての申告になり
１０４０NRのフォームを使います。さらにこの申告書には、日本のアメリカ大使館
で永住権の放棄に関する確認のフォームを添付し、さらに、この年の申告が
永住者として最後の申告である旨のステートメントを添付しIRSに対して
通知する必要があります。

さらにアメリカ国籍をもっている方が日本に帰国する場合には、永久的に
申告を日本から毎年する義務があります。
特にソーシャルセキュリティの年金受給者の場合には、死亡するまで
所得の有無に関係なく毎年日本からタックスリターンをする必要があります。

2020年の２月３日にサンフランシスコにいきます。
ユニオンスクエア付近でホテルを手配しょうと考えてますが、なぜか２月３日が高いです。
調べたところ、祭日でもないのですが。
この日は何かあるのでしょうか？
