City of Fremont Notice of Public Hearing: Building Appeals Board Fee Amendment

In September 2024, the Fremont City Council established a three-member Building Appeals Board [ https://www.fremont.gov/government/departments/city-clerk/boards-commissions-committees/building-appeals-board ] to hear and decide appeals of orders, decisions, and determinations made by the City's Building Official and Fire Chief/Fire Marshal related to building and fire codes. A fee of $2,101 was adopted to recover the City's costs for these appeals.

City staff is now recommending amending the City’s Master Fee Schedule [ https://www.fremont.gov/government/departments/finance/master-fee-schedule ] to replace the single appeal fee of $2,101 with the following three separate appeal fees:


* a $335 fee for appeals of administrative citations;
* a $770 fee for appeals of a Building Official determination and any other non-specified appeals; and
* a $960 deposit-based fee for appeals of 1) a City order to abate a nuisance or 2) a City order to vacate a property; if costs are less than the deposit, the remaining balance would be refunded.

On Tuesday, February 18 at 7:00 p.m., the Fremont City Council will consider staff’s recommendation to amend the Master Fee Schedule and replace the single appeal fee with the three separate fees. The public hearing will take place in the City Council Chambers at City Hall, located at 3300 Capitol Avenue, and will also be held virtually via Zoom. The agenda will be available online through the City's Agenda Center [ https://www.fremont.gov/government/agenda-center ] no later than Friday, February 14 at 5:00 p.m. It will include a link to a staff report for more information and instructions for participating and providing public comment.
