2011年のタックスリターンの申告時期になりましたので、ご質問にお答えしたいと思います。
毎年、ご質問いただいておりますが、書き込まれている情報が不完全なために、正確な回答ができず、大まかな返答になってしまう事が多くあります。
(例:J1Visaで働いています。1040NRのフォームが必要とでてきます。この1040NRを提出すればFederalはほとんど全額戻ってくるのでしょうか?):ここに書き込まれている情報だけでは、1040NRに該当するのか、1040の申告になるのか、判断ができません。
本年からは、ご質問の際、下記の点に留意ください。
1)質問の内容に関わらず、米国の滞在ビザ、ビザの方は訪米年月日、所得の詳細(W-2などの金額)、を必ず、明記してください。
2)申告用のフォーム(1040, 1040NR等)、Tax Tableなどは、ご質問の前にIRSのサイトから、あらかじめダウンロードしておいてください。
3)ご夫婦で申告される方は、必ず作成者の方が質問してください。

早速にありがとうございました。
なぜ自分でもW-2の明細を途中でやめてしまったのかわかりません。(汗)
全部書きますと...
W-2 :③SS wages-$2800
④SS Tax withheld-$146.87
⑤M Wages&Tips-$3500
⑥M Tax withheld-$50.71
⑦SS Tips-$708.00
息子が大学のオフィスの人に『きみはファイナンシャルエイドをもらっているから、Taxリターンをしても戻ってこないよ』と言われたそうです。
こういうことってあるのでしょうか?
それともう一つ確認をしたのですが...
息子は19歳でフルタイムの学生なので、扶養にいれることも出来るし、
息子も自分でTaxリターンをしたら、払った額が戻ってくるということでしょうか?(控除額のことを注意すれば)
再度の質問で申し訳ありませんが、宜しくお願い致します。

申告する事によって、FEDERALは$147.00のリファンドになります。
大学の方の説明の根拠は、前回私が説明しました。
1098-Tに原因があると判断できます。大学の人は、息子さんが未だ19才で
親の扶養家族であることを考慮しないで判断したものと思われます。
つまり、$3,500.00から、$36.00の実際の学費を引いた$3,464.00が追加の
所得になった場合には、お子さんの総所得学が$6,964.00($3,464.00 + $3,500.00)になります。しかし、お子さんの控除額が$5,800.00ですので、リファンドではなく支払いになってしまうという判断です。
これを大学側が指摘していると思います。
しかし、大学側(特にこの発言をしたスタッフ)は、19歳で、フルタイムの学生の場合には、このファイナンシャルエイドの金額は親の申告で課税になりますので、息子さんのタックスリターンでは、この額は加算されません。その事をこの人は
知らなかったものと思われます。

前回の説明と同じです。
息子さんは、19歳で学生ですので、IRSの規定で、扶養家族になります。従って親の申告で控除できますし、また、息子さんの所得に関しては、息子さんの名前でシングルで申告できます。唯一注意する点は、お子さんのEXEMPTIONである$3700.00は親の申告で使用されていますので、お子さんの申告ではEXEMPTIONはとれず、STANDARD DEDUCTIONの$5,800.00のみの控除になります。
ただ、もしこの説明でも不安でしたら、プロにお願いするのもお考えになられたらどうでしょう。

ご質問にお答えする前に、TAX TREATYに関する説明をさせてください。
今年頂いた、いままでの質問とそれに対する私の回答にはTAX TREATYに関するものがなかったので、しかし、ロスにこのタックスリターンのトッピックを
たてた8年前から、毎年必ず1−2度はこのTAX TREATYに関する質問が出てきて
回答してきました。今年再度、この問題に関して説明を繰り返します。
良く読んでご理解ください。
まず、TAX TREATYの処置を受け、給与を課税所得から削除できるのか。その手続きからご説明します。
まず、IRSのサイトにある説明を下記抜粋しましたので、ご参照ください。
Claiming Tax Treaty Benefits
Exemption from Withholding
If a tax treaty between the United States and your country provides an exemption from, or a reduced rate of, withholding for certain items of income, you should notify the payor of the income (the withholding agent) of your foreign status to claim the benefits of the treaty. Generally, you do this by filing Form W-8BEN, Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding (PDF) with the withholding agent.
A reduced rate of withholding applies to a foreign person that provides a Form W-8BEN claiming a reduced rate of withholding under an income tax treaty only if the foreign person provides a U.S. Taxpayer Identification Number (TIN) (except for certain marketable securities) and certifies that:
It is a resident of a treaty country;
It is the beneficial owner of the income;
If it is an entity, it derives the income within the meaning of Section 894 of the Internal Revenue Code (it is not fiscally transparent); and
It meets any limitation on benefits provision contained in the treaty, if applicable.
If the payor knows, or has reason to know, that an owner of income is not eligible for treaty benefits claimed, he must not apply the treaty rate. He is not, however, responsible for misstatements on a Form W-8, documentary evidence, or statements accompanying documentary evidence for which he did not have actual knowledge, or reason to know that the statements were incorrect.
Students, trainees, teachers, and researchers
Alien students, trainees, teachers, and researchers who perform dependent personal services (as employees) can also use Form 8233 to claim exemption from withholding of tax on compensation for services that is exempt from U.S. tax under a U.S. tax treaty.
Students, trainees, teachers, and researchers must attach the appropriate statement shown in Appendix A (for students) or Appendix B (for teachers and researchers) at the end of Publication 519 (PDF) to the Form 8233 and give it to the withholding agent.
上記の英文の概要は下記になります。
「自分のステータスが日米租税条約に該当する場合には、まず、給与支払者(雇用主)にFORM W-8BEN(Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding)
あるいは、FORM 8233 (Exemption From Withholding on Compensation for Independent (and Certain Dependent) Personal Services of a Nonresident Alien Individual)を提出して、自分のステータスが日米租税条約に基づき、所得免除に
なる旨を申告しなければならない。」とあり、
さらに、その後に、説明として、
「もし、雇用者が申告された租税条約が所得に適用にならないと判断した場合には、条約に基づいたレートを適用しなくても
なんら責任をとわれるものではない。」と記載されております。
さらに、雇用者側は、TAX TREATYに基づいて、所得を免除処理した場合には、その証拠として、1042-S(Foreign Person's U.S. Source Income Subject to Withholding)というフォームを発行します。
これは、TAX TREATYによって免除された所得をIRSに対して申請する為のフォームで、下記の抜粋にその説明があります。
You must file a Form 1042-S even if you did not withhold tax because the income was exempt from tax under a U.S. tax treaty or the Code, including the exemption for income that is effectively connected with the conduct of a trade or business in the United States, or you released the tax withheld to the recipient.
上記のIRSの説明で分かりますように、TAX TREATYの減免処置、手続きをするのは、雇用者であり、日本からこられた方は、自分の雇用者に対して,「自分のステータスは、TAX TREATYによって、所得を免除されたものです。」という
意味の説明をフォームによって行う(当然、雇用開始時期に)
そして、雇用者がその要請に基づいて、給与を課税せずに毎月支払い、その結果を1042-Sというフォームにして、翌年、IRSとご本人に渡します。
そしてこの1042-Sのフォームに記入された免除所得額が、1040NRの22番に
ありますTotal income exempt by a treatyの欄に記入されて申告となります。そして、1040NRの左側に有ります添付を必要とするフォームの中にW-2の次に1042-Sが記載されております。
長くなりましたが、TAX TREATYによる所得免除のプロセスは、下記の順番になります。
1)本人から雇用者にW-8BENあるいは、FORM 8233を提出して、TAX TREATYによる所得免除措置を要求する。
2)雇用者側がその要請を判断し、TAX TREATYが適用と判断した場合には、所得からの源泉をせずに支払いをおこなう。
3)年末に、雇用者は、その処置の結果を、本人とIRSに1042-Sを発行して通知する。
4)本人は、1040NRに1042-Sを添付し、免除された所得をフォームの22番に記入してタックスリターンをおこなう。

フェデラルが$3,067.00の支払い、STATEが$779.00の支払いになります。

2012年分のタックスリターンを、2012年にする事はできません。
第一の理由は、2012年の税率および税法が12月31日まで決定しないからです。あくまでも申告は2013年になってから日本から行います。

勤務先と緊密に連絡が取れる関係であるなら、まず、第一番に確認しなくては行けない事は、「何故、TAX TREATYの所得免除の手続きをしてくらなかったのか?」という点になると思います。この点は、早急に確認して頂きたいと思いますし、その結果を書き込みでご連絡ください。多分、Jビザで来られている方でTAX TREATYの処置をとられていない方たちは、最も聞きたい情報だと思いますし、私もプロとして、「何故、JビザのRESEARCHERを受け入れていながらTAX TREATYの処理をしていないのか。」大変興味があります。

多分、W-2を2つ発行する事はしてくれないと思います。それは、申告を2つに分けてすることが
事実上不可能だからです。無駄な事はしないことです。

2012年の申告は1040にはなりません。1040NRになります。理由は簡単です。いかに年間183日以上アメリカに滞在しても、12月31日(2012年)にアメリカに在住していない人は1040NRでの申告になるからです。
大変長くなりましたが、まず、TAX TREATYの理解と、雇用者へのこの件に関する質問を先にしてから、ご返答をください。

是非タックスについて御教示いただきたく思います。
2010年10月~J-1ビザ(トレーニング)で米国に滞在しております。
前回は知人にタックスの処理をして貰ったのですが(フェデラル全額リターンでした)
帰国してしまいましたので、今回は自力での申請をするべく、色々やっているのですが・・・。
自分で計算してみると、リターンどころか追加で税金の支払い義務が生じます($220程度)。
それが正しければ勿論追加でお支払いするつもりなのですが、素人判断では不安でしたので、
私の場合、本当に支払いが必要なのか、またはリターンがあるのか、御教示頂ければ幸いです。
所得の詳細:W-2に記載されている額です。
