Update on Air District Rule for Residential Water Heaters

On July 14, the Bay Area Air District (Air District) (https://www.baaqmd.gov/) released a draft of amended rule language (https://www.baaqmd.gov/~/media/dotgov/files/rules/reg-9-rule-4-nitrogen-oxides-from-fan-type-residential-central-furnaces/2021-amendments/documents/rg0906_strikethrough_07132026-pdf.pdf?rev=b21727ab0be54ae8a8b037d405fdf8c9≻_lang=en) outlining potential exemptions and a delayed start date for their residential water heater requirement under Rule 9‑6 (https://www.baaqmd.gov/rules-and-compliance/rule-development/building-appliances) .

Water Heater Rule
This rule is intended to phase out the sale and installation of new gas‑powered water heaters—if an existing gas water heater fails, it must be replaced with a compliant, zero‑emission electric model. Property owners are not required to remove or replace any functioning equipment. The goal is to reduce air pollution and support regional clean air goals.

Draft Amendments
The draft amendments 1) push the start date for the new water heater rule from January 2027 to January 2028, and 2) outline exemptions for low‑income property owners and for situations where electrical panel limitations or space constraints make installing an electric water heater particularly difficult or costly. The amendments are intended to help address affordability and installation challenges while maintaining the rule’s intended public health benefits.

Public Review and Comment
The draft amended rule language and supporting materials are available for public review and comment by visiting the Air District’s Building Appliances webpage (https://www.baaqmd.gov/rules-and-compliance/rule-development/building-appliances) . The deadline for submitting comments is Thursday, August 13 at 6:00 p.m.

Next Steps
The Air District Board is expected to revisit and potentially adopt the final rule language this fall, with a decision tentatively scheduled for November 2026.

The City is excited to participate in National Coastal Cleanup Day (https://city.fremont.gov/coastalcleanupday) again this year on Saturday, September 19 from 9:00 a.m. to 12:00 p.m. This annual event is more than just a cleanup—it’s a celebration of community spirit and environmental stewardship!

We’ll be hosting various volunteer cleanup events throughout Fremont to help keep our local creeks and waterways free from litter and debris. Mark your calendar for Wednesday, August 19 at 6:00 a.m. This is when registration will open through our Coastal Cleanup Day webpage (https://city.fremont.gov/coastalcleanupday) . Join us as we roll up our sleeves to protect our local creeks and waterways. By reducing waste and protecting our natural resources, we can make a real difference. Last year, 201 volunteers collected 1,620 pounds of trash, 318 pounds of recyclables, and 200 pounds of compostable material. Let’s work together to achieve an even greater impact this year!

California Climate Credit

In August and September, residents will receive the California Climate Credit (https://avaenergy.org/insight/the-california-climate-credit/) . The credit is funded by the State of California’s Cap-and-Invest Program, which collects money from large polluters. Every year, some of that money is used by California to fight climate change, and some goes directly to customers in the form of a bill credit. This year, residents will receive an electric credit of $36.18 in August and $36.18 in September. The credits are automatically applied to eligible customers’ PG&E bills.

Mercury Thermostat Recycling

If you have an old wall thermostat, it may contain mercury, which can be harmful if thrown in the trash. Fremont residents can safely recycle these devices through Thermostat Care (https://thermostatcare.org/) and receive a $30 rebate for each mercury thermostat returned.

How It Works
* Complete the form: Download, fill out, and print the rebate form at thermostatcare.org (https://thermostatcare.org/) .
* Bag it: Place your old mercury thermostat in a sealed plastic bag along with the completed rebate form.
* Drop it off: Bring it to the Fremont Household Hazardous Waste Facility (https://www.fremont-recycling.com/hhw.html) at 41149 Boyce Road. The facility is open Wednesday through Friday from 8:30 a.m. to 2:30 p.m. and Saturday from 8:30 a.m. to 4:30 p.m.
* Get $30: A rebate check will be mailed to you.

Recycling mercury-containing thermostats is a simple way to protect our community and the environment. By keeping hazardous materials out of the trash, you’re helping reduce pollution and supporting a safer, healthier Fremont. Thanks for doing your part!
